Terms of Service

1. Acceptance

By using DripDraft ("the Service"), operated by Fluency Digital ("we", "us"), you agree to these terms. If you don't agree, don't use the Service.

2. The Service

DripDraft is an AI-powered email tool that helps you create and manage follow-up email sequences. Follow-up emails are stored as drafts within DripDraft for you to review, edit, and send manually through your Gmail account. You retain full control over what gets sent.

3. Account

You sign in using your Google account. You are responsible for all activity under your account. You must have the right to use the Google account you connect.

4. Acceptable Use

DripDraft is designed for personalized, one-to-one professional outreach — not bulk or mass email. You are solely responsible for the emails you send through your Gmail account using DripDraft.

You agree not to use DripDraft to:

• Send spam, unsolicited bulk email, or mass marketing messages
• Violate the Gmail Program Policies, Google Terms of Service, or any other Google policies governing your Gmail account
• Violate the CAN-SPAM Act, GDPR, CASL, or any applicable anti-spam, privacy, or electronic communications law
• Harass, threaten, or abuse recipients
• Impersonate others or misrepresent your identity
• Send malware, phishing, or deceptive content
• Use deceptive subject lines or misleading "From" information
• Exceed Gmail's sending limits or abuse the Service infrastructure

Your responsibilities under CAN-SPAM and applicable law:

• You must ensure your emails are not misleading in their subject line, sender name, or content
• Commercial emails must include your valid physical mailing address (this can be included in your signature)
• You must honor opt-out or unsubscribe requests promptly
• You must have a lawful basis for contacting each recipient and comply with all applicable laws in the recipient's jurisdiction

Enforcement:

We reserve the right to suspend or terminate any account that generates excessive bounce rates, spam complaints, or that we reasonably believe is being used for spam or abuse. We may also report violations to Google or law enforcement where appropriate. You agree to indemnify Fluency Digital against any claims, damages, or losses arising from emails you send using the Service.

5. Plans & Payment

Free plan: 10 campaigns per month, no payment required.

Starter plan: $7.99/month for 100 campaigns. Billed monthly via Stripe. You can cancel anytime from the Account page or Stripe billing portal. No refunds for partial months.

We reserve the right to change pricing with 30 days' notice.

6. AI-Generated Content

DripDraft uses AI to generate email drafts. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all drafts before sending. We are not liable for the content of emails you send.

7. Your Content

You own the content you create (emails, templates, contacts). We don't claim ownership. We use your content only to provide the Service. When you delete your account, all your content is permanently deleted.

8. Limitation of Liability

The Service is provided "as is" without warranties. We are not liable for any damages arising from your use of the Service, including but not limited to: emails that fail to send, drafts not created, incorrect AI-generated content, or lost data. Our total liability is limited to the amount you paid us in the last 12 months.

9. Termination

You can delete your account at any time from the Account page. We may terminate accounts that violate these terms. Upon termination, all your data is deleted.

10. Changes

We may update these terms. Continued use after changes constitutes acceptance.
